• OT: Triple-murder mistrial

    It's official, it's been declared a mistrial. As I've said, I could've
been a hung jury of one ...inasmuch as I could neither declare her meaningfully responsible nor could I allow even the possibility of her eventual return to society.

    Btw, this headline:

Plymouth County District Attorney Timothy Cruz said the
prosecution’s case has “always been about getting justice for those
    three little babies.”

...reminds me that we are still living certain Dark Ages. Does he
imagine that, if we could somehow speak to those departed little souls,
they'd be clamoring for Mommy's execution ...or, perhaps more
rationally, that *any* punishment for her could ever square things up?

Wasn't she going to end up being put away for life in either case? So
she wasn't getting back into society, it was just a question of where
would she spend the rest of her life. In a mental institution or
    prison.

I'm speculating, but... if a jury chooses "not criminally responsible",
I'd be surprised that she could then be sentenced to, e.g., "medical
custody without the possibility of parole".

Our society has completely failed when it excuses a woman who choked
her three children to death. We've opened a door we're gonna wish we
    hadn't.

Absolute kudos to the man who refused to go along with this nonsense.
It seems to me the 11 tried to bully this guy and create a narrative
that "he wasn't following the law" and tried to get him tossed from
    the jury.

A disgrace from beginnning to end.

The defense-- bizarrely-- was given leave to file an interlocutory appeal, claiming that if one juror doesn't go along with all the others, the rest of the jury should be able to vote him out, like a jury is some half-assed
reality show like, SURVIVOR or something.

    Absolutely unreal.

Also, with respect to dissenting juries, don't some states allow for convictions even when only 9 or 10 of the jurors vote guilty? I'm

Sounds constitutional to me. In 2019, John Roberts wrote the two
opinions giving voters no rights not to be gerrymandered into districts
for a predetermined outcome. The concept could be extended to juries.

You heard that a federal prosecutor got in trouble for excusing two
jurors from a grand jury who refused to indict in some of the Broadview
    Six charges?

Apparently he was the only one who had retained some basic bit of sanity and wanted to convict her.

Would a not guilty verdict result in her being set free or would it see
her confined to a mental institution? If the latter, for how long?

If I understand these things correctly, confinement to a mental
institution is normally only until the patient is "cured" (or at least "manageable"). We had a guy here a few years back who had a psychotic
break while on a long Greyhound journey. He killed the guy sitting next
to him and ate part of him before the police apprehended him. He was
found unfit to stand trial and institutionalized. A few years later, the shrinks were convinced he was safe to be let out as long as he kept
taking his meds so the authorities set him up with a new identity and
let him out. (As far as I know, he hasn't re-offended.)

Also, with respect to dissenting juries, don't some states allow for

There is no information available on that but logic pretty much tells
us that the 11 wanted to find her cray-cray. The holdout seemed to be
from the position of "she did it. end of story".

The way the defense tried to get this juror removed tells me:
a: he had a leaker in the jury let him know what the situation
    b: he knew the outcome
c: he belongs in jail for the way he lectured the judge.
